Terms of Service

How buying, selling and making objects works on OAC, and what everyone can expect from each other.

Draft for legal review. This is a starting template, not legal advice. Have a qualified lawyer review it and complete the highlighted fields before OAC opens to the public. It is not in effect until a lawyer has reviewed it and an effective date is set.

01Who we are

OAC ("Of All Creation", "OAC", "we") is a marketplace operated by [Company legal name], [registered address]. These Terms govern your use of the OAC website, apps and services. By creating an account or buying, selling or making anything on OAC, you agree to these Terms.

02Your account

  • You must be at least [minimum age, e.g. 16] years old, or the age of majority where you live if you sell, to use OAC.
  • Keep your sign-in details secure. You are responsible for activity on your account.
  • Give accurate information, including when you list an object or place an order.
  • One person or business may not run accounts to manipulate reviews, rankings or prices.

03Buying on OAC

OAC lets independent creators sell three kinds of things:

  • Digital files: fabrication files such as STL, 3MF or STEP, delivered through your library after payment. You get a license to use them, not ownership of the design.
  • Finished objects: physical objects made and shipped by the creator.
  • Mini Manufacturer orders: physical objects made from the creator's approved files by an independent maker in the OAC network, then shipped to you.

The creator (and, for network orders, the maker) is the seller of the object. OAC provides the marketplace, payment processing through our payment partner, and the ordering and support tools. The 3D preview and configuration are representations; colors, materials and finishes of printed objects can vary.

04Selling on OAC

If you list objects or files, the Creator Agreement also applies to you. If you make objects for others as a Mini Manufacturer, the maker terms in that agreement apply.

05Licenses for digital files

Each digital listing shows its license. Unless the listing says otherwise, a Personal license lets you make objects from the files for your own non-commercial use. It does not let you resell, share or re-upload the files, or sell objects made from them.

Commercial and Extended licenses allow additional uses described on the listing and in any license terms the creator adds. If the creator's terms and these Terms conflict about a file, the creator's license terms apply to that file.

06Payments, fees and taxes

  • Payments are processed by [payment processor, e.g. Stripe]. OAC does not store your full card number.
  • Prices are shown before checkout. Applicable sales tax, VAT and shipping are calculated at checkout.
  • Creators pay OAC a platform fee described in the Creator Agreement. Buyers do not pay a separate OAC fee unless it is shown at checkout.

07Cancellations and refunds

  • Digital files: because files are delivered immediately, sales are final once you download them, except where the file is materially different from its listing, is corrupt, or the law gives you a right to a refund.
  • Physical objects: you can cancel before production starts. After that, refunds are available for objects that arrive damaged, defective or materially different from the listing and configuration you ordered. Report problems within [number] days of delivery.

Nothing in these Terms limits rights you have under consumer protection law where you live.

08Acceptable use

You may not use OAC to list, sell, share or make:

  • Work you don't own or have the rights to sell, including re-uploads of others' designs.
  • Firearms, firearm components, weapon accessories regulated where you or the buyer live, or other weapons.
  • Items designed to evade law enforcement, harm people, or circumvent safety devices.
  • Hateful, harassing, sexually explicit or illegal content.
  • Counterfeits, or objects that copy trademarks or characters without permission.

Don't manipulate reviews, rankings or prices, scrape the service at scale, interfere with its security, or use it to send spam.

09Content you share

You keep ownership of the reviews, photos of your makes, saved configurations and other content you post. You give OAC a worldwide, non-exclusive, royalty-free license to host, display, adapt for display (for example, resizing images or rendering previews) and promote that content in connection with OAC. You can delete your content; copies may remain in backups for a limited time.

10Intellectual property and takedowns

We respect creators' rights and act on valid notices of infringement. See Copyright & Takedowns for how to report a listing and how we handle repeat infringers.

11Making objects safely

Objects made from digital files depend on the printer, material, settings and person making them. Printed objects are not toys unless the listing says they meet applicable toy safety standards, and are not food-safe unless stated. Follow the creator's guidance and your equipment's safety instructions. You are responsible for objects you make yourself.

12Disclaimers and limits of liability

OAC is provided "as is". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Creators and makers are responsible for their listings and objects.

To the extent the law allows, OAC's total liability to you for any claim is limited to the greater of the amount you paid OAC in the 12 months before the claim or [amount], and OAC is not liable for indirect or consequential losses.

13Suspension and termination

You can close your account at any time. We may suspend or remove accounts, listings or content that break these Terms or the law, or that put others at risk. Where possible we'll tell you why and give you a chance to respond. Files you have already purchased remain available in your library unless they were removed for infringement or safety reasons.

14Changes to these Terms

We may update these Terms. For material changes, we'll give at least [number] days' notice by email or on the site before they take effect.

15Governing law and disputes

These Terms are governed by the laws of [jurisdiction]. Disputes will be handled in [courts or arbitration forum], except where consumer law gives you the right to bring a claim where you live.
